Legal
Terms of Service
Last updated October 9, 2026. The plain-language summary is first; the full terms follow.
In short: Rehostly is software that lets vacation-rental hosts in Canada run their own booking site and take payments through Stripe. When a guest books, the rental agreement is between the guest and the host, not Rehostly. Guests pay the host's price plus a 4% booking fee; hosts receive their price less a 4% fee. Each listing has a cancellation policy that decides refunds. Hosts are responsible for their property, their listing, local short-term rental rules and their taxes.
These Terms of Service ("Terms") are a legal agreement between you and Rehostly. Please read them carefully. Section 13 limits our liability and section 17 explains how disputes are resolved.
1. Who we are
1.1 Rehostly is a Canadian-based company, built and run on Vancouver Island, British Columbia. In these Terms, "Rehostly", "we", "us" and "our" mean Rehostly.
1.2 You can reach us at support@rehostly.ca.
1.3 Some words used in these Terms:
- Host: a person who has a Rehostly account and offers a property for short-term rental.
- Guest: a person who books, or tries to book, a stay through a host's Rehostly site. A guest does not need a Rehostly account.
- Site: a host's booking website made with Rehostly, at rehostly.ca/[name] or at a domain the host connects.
- Listing: a property a host offers on their site, with its photos, description, prices, rules and calendar.
- Host's price: the total the host charges for a stay. It is made up of the nightly rates plus any cleaning, extra-guest and pet fees the host sets.
- Booking: a reservation of a listing for specific dates made through a site.
2. Using Rehostly
2.1 What Rehostly does. Rehostly provides software for hosts to build a site, show their listings, manage a calendar, accept bookings and communicate with guests. Through our payment provider, Stripe, we also collect guests' payments and send hosts their share.
2.2 What Rehostly does not do. Rehostly does not own, manage, inspect or control any property. We are not a travel agent, real estate agent, property manager or insurer. We do not employ hosts and we do not act for guests.
2.3 The rental agreement is between host and guest. When a booking is confirmed, the guest and the host enter into an agreement for the stay. That agreement is made up of the listing (including its house rules and cancellation policy), the booking details shown at checkout, and any additional terms the host shows the guest before they book. Rehostly is not a party to it. The host, not Rehostly, is responsible for providing the stay.
2.4 Who these Terms apply to. These Terms apply to everyone who uses Rehostly: hosts, guests, and anyone who visits rehostly.ca or a site. Some sections apply only to hosts or only to guests, and say so.
2.5 Accepting these Terms. Hosts accept these Terms when they create an account. Guests accept them when they make a booking. If you do not agree, do not use Rehostly.
2.6 Age. You must be at least 18 years old, and able to enter into a binding contract, to create a host account or make a booking. Children may stay as part of a booking made by an adult.
2.7 Privacy. Our Privacy Policy explains how we handle personal information. It forms part of these Terms.
3. Accounts and host approval
3.1 Your account. Hosts must give accurate and complete information when they sign up and keep it up to date. Keep your password secure and do not share your account. You are responsible for everything done through your account. Tell us right away at support@rehostly.ca if you think someone has used it without permission.
3.2 Who can be a host. To take bookings, a host must:
- be at least 18;
- own the property, or have the legal right to rent it out (for example, the owner's written permission, or permission under your lease or strata bylaws);
- offer properties located in Canada; and
- open and keep a Stripe account in Canada, with a Canadian bank account, in good standing.
If you use Rehostly on behalf of a business, you confirm you have authority to bind that business, and "you" includes the business.
3.3 Approval. We review every host before their listings can go live or take payments. As part of this review we look at information from your Stripe account (see our Privacy Policy). We usually finish within one business day. We may ask for more information. A person at Rehostly makes each decision.
3.4 Our right to refuse. We may refuse to approve a host, or withdraw an approval later, if we reasonably believe the host poses a risk of fraud, loss or harm to guests, to other hosts, to Stripe or to us, or does not meet these Terms. Where we can, and where the law and our fraud-prevention duties allow, we will tell you why.
4. Fees
4.1 No subscription. Rehostly does not charge a monthly or setup fee. We earn a fee only when a guest pays for a booking.
4.2 How the fee works. Rehostly's fee is 8% of the host's price. It is shared:
- Guests pay a booking fee of 4% of the host's price, on top of that price. It is shown at checkout before the guest pays.
- Hosts pay a fee of 4% of the host's price. It is deducted before the host is paid.
The same split applies to each payment, so a deposit and a balance are each charged this way.
Example: A host's price for a stay is $1,000. The guest pays $1,040 ($1,000 + a $40 booking fee). Rehostly keeps $80. The host receives $960.
4.3 Card processing. Rehostly pays Stripe's card processing fees out of its share. Hosts do not pay processing fees on bookings, except as set out in section 6 for guest cancellations.
4.4 Currency. All prices, fees, payments and payouts are in Canadian dollars (CAD). A guest whose card is in another currency may be charged foreign exchange or other fees by their bank. Those fees are not Rehostly's.
4.5 Taxes on our fees. Our fees do not include any sales tax. If we are required to charge GST/HST or another tax on our fees, we will add it and show it.
4.6 Different fees. We may agree a different fee with a host in writing. We may change our fees by giving notice under section 16. A fee change never applies to a booking already made.
5. Payments, deposits and balances
5.1 Stripe. Payments on Rehostly are processed by Stripe through Stripe Connect.
- Hosts must accept the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (together, the "Stripe terms"). Your relationship with Stripe is between you and Stripe. You authorize us to share information about you and your bookings with Stripe, and to receive information about your Stripe account from Stripe, so we can run payments, verify accounts and prevent fraud.
- Guests pay by card through Stripe's secure payment form. We never see or store full card numbers.
5.2 Rehostly collects payment for the host. When a guest pays for a booking, Rehostly accepts that payment as the host's limited agent for collecting payment. Once the guest's payment is received, the guest has paid the host that amount, even if the host has not yet received it. Your card statement may show Rehostly's name.
5.3 Paying in full or by deposit. Each listing sets whether guests pay in full when they book, or pay a deposit (between 10% and 100% of the host's price) with the balance due later. The amounts and dates are shown at checkout.
5.4 Automatic balance payment. If a booking has a balance, it is charged automatically to the card the guest used to book, on the date shown at checkout. That date is a number of days before check-in set by the host (7 days unless the host chooses otherwise). By booking with a deposit, the guest authorizes Rehostly, through Stripe, to save their card and charge the balance plus the 4% booking fee on it on that date. The guest can ask the host to arrange another way to pay before that date.
5.5 If a balance payment fails. If the card is declined, we try again the next day. If it fails again, we email the guest a secure link to pay and let the host know. The booking is not cancelled automatically. If the balance is still unpaid at check-in, the host may cancel the booking. In that case the deposit is refunded as if the guest had cancelled on that day (see section 6.3).
5.6 Instant booking and requests to book. Each listing uses one of two ways to book:
- Instant booking. The booking is confirmed and the guest's card is charged right away.
- Request to book. The guest's card is authorized (a hold is placed) but not charged. The host has 18 hours to accept. If the host accepts, the card is charged and the booking is confirmed. If the host declines or does not answer in time, the request expires and the hold is released. The guest's bank decides how quickly a released hold disappears from their account.
5.7 Dates are held during checkout. While a guest is paying, the dates are held for them for up to 30 minutes.
5.8 Payouts to hosts. When a guest's payment is charged, the host's share is sent to the host's Stripe account. Stripe then pays it out to the host's bank account on Stripe's payout schedule. Rehostly does not control payout timing and is not responsible for delays by Stripe or banks.
5.9 Refunds, reversals and amounts hosts owe. If a payment is refunded (for example, after a cancellation), the host's share is taken back from their Stripe account in the proportion described in section 6. If the host's Stripe balance cannot cover it, the balance may become negative and Stripe may recover the amount from future payouts or from the host's bank account, as the Stripe terms allow. The host must repay Rehostly any amount it pays for which the host is responsible, including refunds owed by the host and chargebacks under section 5.10.
5.10 Chargebacks. If a guest disputes a payment with their bank (a "chargeback"), we will work with the host to respond. If the dispute is lost because of something the host is responsible for (for example, the property was not available or was materially different from the listing), the host is responsible for the disputed amount and any dispute fee, and we may recover it as set out in section 5.9.
5.11 Price errors. Prices are calculated by our system from the listing at the time of booking. If the price changes while a guest is checking out, we ask the guest to refresh and see the new price before paying. If an obvious error leads to a clearly wrong price, we may cancel the booking and refund the guest in full.
6. Bookings, cancellations and refunds
6.1 Cancellation policies. Each listing has one of three cancellation policies. The policy shown when the guest books applies to that booking, even if the host changes it later.
| Policy | Guest can cancel for a refund up to and including |
|---|---|
| Flexible | 3 days before check-in |
| Moderate | 14 days before check-in |
| Strict | 30 days before check-in |
Days are counted using calendar dates in Pacific time. If a guest books after the last cancellation day has already passed, there is no free cancellation for that booking.
6.2 Guest cancels before the cut-off. A guest can cancel online, from their booking page, up to and including the last day their policy allows. They get back everything they paid, including the booking fee, less Stripe's processing fee on each payment (about 2.9% plus 30 cents for a Canadian card, and more for some cards). Rehostly keeps that amount to cover the cost Stripe charged it. The host's share and Rehostly's fee are reversed in full.
6.3 Guest asks the host to cancel. After the last cancellation day, the guest cannot cancel online, but they can ask the host to cancel. The host then decides whether to refund anything and how much. (If a guest asks the host to cancel before the cut-off, the host must refund at least what the policy allows, which is everything the guest paid.) If the host refunds part of what was paid, the host's share and Rehostly's fee are each reduced by the same proportion as the refund. For example, if the host refunds half of what the guest paid, the host gives up half of their share and Rehostly gives up half of its fee.
6.4 Host cancels. A host should cancel only when they truly must. If a host cancels a confirmed booking for any reason other than the guest's own request, the guest gets back everything they paid, including the booking fee. The host's share and Rehostly's fee are reversed in full. Hosts who cancel often or without good reason may lose access to Rehostly.
6.5 Declined and expired requests. If a host declines a request to book, or it expires, the guest is not charged and the card hold is released.
6.6 Refunds when a stay cannot go ahead. If a property is not available, is unsafe, or is materially different from its listing, the guest should contact the host first. If the host and guest cannot resolve it, the guest can contact us at support@rehostly.ca. We are not obliged to decide the dispute, but we may help. We may cancel a booking and refund the guest if we reasonably believe it is needed to prevent fraud or harm, to comply with the law, or because the host has seriously breached these Terms. In that case the host's share is reversed and section 5.9 applies.
6.7 How refunds are paid. Refunds go back to the card used to pay. Banks usually take 5 to 10 business days to show a refund.
6.8 Consumer rights. Nothing in this section takes away any right a guest has under consumer protection law that cannot be waived by contract.
7. Hosts' responsibilities
7.1 Your listing must be accurate. Your listing, photos, prices, fees, house rules, availability and cancellation policy must be accurate, complete and kept up to date. Do not leave out anything a reasonable guest would want to know before booking (for example, stairs, shared spaces, construction, pets on site or security cameras). Do not use photos of a different property.
7.2 Short-term rental laws. You are solely responsible for knowing and following every law, bylaw, rule and contract that applies to renting your property, including:
- provincial short-term rental rules (for example, British Columbia's Short-Term Rental Accommodations Act and its registration requirements);
- municipal zoning, business licence and registration requirements, and principal-residence rules;
- strata, co-op, condominium and lease rules; and
- health, safety, fire and building codes.
Where a law requires a registration or licence number to be displayed on your listing, you must display it. If a government authority asks us to remove a listing or to provide information about it, we may do so where the law requires or permits.
7.3 Taxes. You are responsible for working out, collecting, reporting and paying all taxes that apply to your rentals and your income. These may include GST/HST, provincial sales tax (such as BC PST), the Municipal and Regional District Tax (MRDT), municipal accommodation taxes and income tax. Rehostly does not currently calculate, collect or remit any of these taxes for you. Your price must include any tax you are required to charge, unless we provide a separate way to show tax. If the law requires Rehostly to collect or remit a tax on your bookings, or to report information about you or your bookings to a tax authority, we will do so and tell you. We may then ask you for information (such as your business number or tax registration) that we need to comply.
7.4 Insurance. You are responsible for having insurance that covers short-term rental use of your property, including liability insurance. Ordinary home insurance often does not cover it. Rehostly does not provide insurance or damage protection.
7.5 Safety. You are responsible for the safety of your property, including working smoke and carbon monoxide alarms, safe access, and anything else the law or a reasonable host would provide. Tell guests about any hazards.
7.6 Honouring bookings. You must honour every confirmed booking at the price and on the terms shown to the guest at checkout. You must not ask a guest to pay more for a booking made through Rehostly, unless the guest agrees to a separate charge after booking (for example, for damage they caused).
7.7 Your calendar. You are responsible for keeping your availability accurate. If you also list your property elsewhere, see section 11.3.
7.8 Communicating with guests. You are responsible for responding to guests, for the messages you send them through Rehostly (including your custom emails, check-in instructions and guest manual), and for giving them what they need to arrive and stay.
7.9 Guests' personal information. You receive guests' personal information to provide their stay. You must use it only for that purpose and for related purposes the law allows, keep it secure, and follow the privacy laws that apply to you. Do not send guests marketing messages unless you have the consent Canada's anti-spam law (CASL) requires.
7.10 Fair treatment. You must not refuse, cancel or treat a guest differently on any ground protected by human rights law, such as race, religion, disability, sex, sexual orientation, gender identity or family status, except as the law allows.
7.11 Damage and disputes with guests. Rehostly does not collect damage deposits or handle damage claims. Any claim for damage, extra cleaning or a breach of house rules is between you and the guest.
8. Guests' responsibilities
8.1 Accurate booking details. Give your real name and contact details, and the true number of guests and pets. The person who books is responsible for everyone in their party.
8.2 The host's rules. Read the listing, house rules and cancellation policy before you book. Follow the house rules, check-in and check-out times, and occupancy limits.
8.3 Respect the property. Leave the property in the condition you found it, apart from normal wear. You are responsible to the host for damage caused by you or your party, beyond normal wear.
8.4 Paying. Make sure the card you book with can pay any balance on its due date (section 5.4). Keep your booking link private: anyone with it can view and cancel your booking.
8.5 Problems during your stay. Contact the host first. In an emergency, call 911 or local emergency services. Rehostly is not able to respond to emergencies.
9. Content and licences
9.1 Your content stays yours. Hosts own the photos, text and other material they add to Rehostly ("your content").
9.2 The licence you give us. You give Rehostly a non-exclusive, worldwide, royalty-free licence to host, store, copy, display, adapt (for example, resize, crop or reformat) and publish your content, for as long as it is on Rehostly and for a reasonable time after to remove it from backups and caches. We use this licence to run your site and Rehostly. We may also show your public site or listing as an example of Rehostly in our own marketing. You can ask us to stop doing so at any time by emailing support@rehostly.ca.
9.3 Your promises about your content. You confirm that you own your content or have permission to use it this way, and that it is accurate, lawful and does not infringe anyone's rights. Do not upload photos that show guests or other people who have not agreed to it.
9.4 The AI writing helper. Rehostly offers an optional "Write it for me" feature. It uses an AI service from Anthropic to draft text from the details you give it (such as your town, amenities and the style you want). AI-written text can be wrong or generic. You are responsible for checking and editing anything it writes before you publish it, as with any of your content.
9.5 Our content. Rehostly, its software, design templates, logos and brand belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use them only to use Rehostly as these Terms allow. When your account ends, so does that right.
9.6 Feedback. If you send us ideas or suggestions, we may use them without paying you or owing you anything.
9.7 Removing content. We may remove or hide content that we reasonably believe breaks these Terms or the law. If you believe content on Rehostly infringes your copyright or other rights, email support@rehostly.ca with the details.
10. Acceptable use
You must not:
- break any law, or help anyone else to do so;
- give false information, pretend to be someone else, or list a property you have no right to rent;
- use Rehostly for fraud, money laundering, or to take payments for anything other than a genuine stay in the listed property;
- post content that is unlawful, misleading, hateful, harassing, sexually explicit or violent, or that infringes someone else's rights;
- send spam, or messages that break Canada's anti-spam law;
- try to get into accounts, data or systems you are not allowed to access, or test, scan or break our security;
- interfere with Rehostly, overload it, or use bots or scrapers on it without our written permission;
- copy, resell or reverse-engineer Rehostly, except as the law allows; or
- use Rehostly to collect payment for a booking and then ask the guest to pay again outside it.
11. Third-party services
11.1 Rehostly relies on other companies' services, including Stripe (payments), Mapbox (maps and address search), Anthropic (the AI writing helper), domain registrars and DNS providers (if you connect your own domain), and Airbnb, Vrbo and other platforms (if you sync calendars). Those services have their own terms and privacy policies. We are not responsible for them or for how they work.
11.2 Your own domain. If you connect a domain you own, you are responsible for registering and renewing it and for its DNS settings. If the domain lapses or is set up wrongly, your site will not be reachable at it.
11.3 Calendar sync. If you link a calendar from Airbnb, Vrbo or another platform, we regularly import its booked dates (about every 20 minutes) and block them on your site. We also give you a calendar link to export your Rehostly bookings to those platforms; it shows only that dates are reserved. Other platforms decide how often they read our calendar, and their feeds can be late, incomplete or wrong. Rehostly refuses overlapping bookings made through Rehostly, but we cannot prevent a double booking caused by a delay or error in another platform's calendar. If a double booking happens, the host is responsible for resolving it, including cancelling and refunding a guest in full under section 6.4.
12. Disclaimers
12.1 We work hard to keep Rehostly reliable, but it is provided "as is" and "as available". We do not promise that it will always be available, error-free or secure, or that it will bring you any bookings or income.
12.2 We do not inspect properties or check that listings are accurate. Apart from reviewing hosts before they take payments, we do not verify the identity or background of hosts or guests. Approval is not an endorsement of a host or a property.
12.3 To the fullest extent the law allows, we exclude all warranties and conditions not set out in these Terms, including implied warranties or conditions of merchantable quality, fitness for a particular purpose and non-infringement.
12.4 Some laws, including consumer protection laws in some provinces, do not allow some of these exclusions. If those laws apply to you, the exclusions apply only as far as they allow.
13. Limitation of liability
13.1 Rehostly is not responsible for the stay itself, or for anything a host or guest does or does not do. This includes the condition, safety or legality of a property, injury or loss during a stay, and cancellations by hosts or guests.
13.2 To the fullest extent the law allows, Rehostly is not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, bookings, data or goodwill, however it arises.
13.3 To the fullest extent the law allows, Rehostly's total liability to you for all claims relating to Rehostly or these Terms is limited to the greater of:
- (a) the fees you paid to Rehostly in the 12 months before the event giving rise to the claim (for a host, Rehostly's fees on your bookings; for a guest, the booking fees you paid); and
- (b) CAD $100.
13.4 Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for fraud, for intentional or grossly negligent conduct, or for bodily or moral injury caused by our fault.
14. Indemnity
14.1 Hosts. If you are a host, you agree to compensate Rehostly, and its officers, employees and contractors, for any claim, loss, liability, fine, tax or reasonable cost (including reasonable legal fees) arising from:
- your listing, your property, or a stay at your property;
- your breach of these Terms or of the law (including short-term rental, tax and privacy laws); or
- your content.
We will tell you promptly about any such claim and let you take part in defending it at your cost.
14.2 Everyone. To the extent the law allows, if you use Rehostly fraudulently or in breach of section 10, you agree to compensate Rehostly for the losses that result.
15. Ending your account
15.1 Hosts closing their account. You can close your account at any time by emailing support@rehostly.ca from the address on your account. Before we close it, you must either honour or cancel (with a full refund under section 6.4) any upcoming confirmed bookings. We will then take your sites offline.
15.2 Our right to suspend or close accounts. We may suspend or close a host's account, take a site or listing offline, or stop a payment if:
- you seriously or repeatedly break these Terms;
- we reasonably believe there is a risk of fraud, illegal activity, or harm to guests, hosts, Stripe or us;
- Stripe restricts or closes your Stripe account;
- we are required to by law or by a government authority; or
- we stop offering Rehostly.
Where we can, we will give you notice and a chance to fix the problem first. Otherwise, for any other reason, we will give you at least 30 days' notice by email.
15.3 What happens to existing bookings. If we close a host's account, we may, depending on the reason, let confirmed bookings go ahead or cancel them and refund guests in full. If we cancel because of the host's breach, the host's share is reversed and section 5.9 applies.
15.4 What survives. Sections that by their nature should continue after an account closes will continue, including amounts owed, sections 5.9, 5.10 and 9 (for content already shared), and sections 12 to 14 and 17.
15.5 Your data. After your account closes, we keep and delete information as our Privacy Policy describes. Ask us before you close your account if you want a copy of your data.
16. Changes
16.1 Changes to Rehostly. We regularly improve Rehostly and may add, change or remove features. If we remove a feature that hosts rely on, we will try to give reasonable notice.
16.2 Changes to these Terms. We may change these Terms. If a change is material, we will tell hosts by email and post a notice on rehostly.ca at least 30 days before it takes effect, unless the change is required sooner by law or is needed to address fraud or security. The new date will appear at the top. If a host does not agree with a change, they may close their account before it takes effect. If they keep using Rehostly after that, they accept the change.
16.3 Bookings already made. A booking is governed by the Terms in place when it was made, unless a later change is required by law.
17. Governing law and disputes
17.1 Governing law. These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.
17.2 Talk to us first. If you have a complaint about Rehostly, email support@rehostly.ca. We will try to resolve it within 30 days. Disputes between a host and a guest about a stay should first be raised between them.
17.3 Where disputes are decided. If a dispute with Rehostly is not resolved, it will be decided by the courts of British Columbia, or by British Columbia's Civil Resolution Tribunal for claims within its jurisdiction (such as small claims). You and we both accept the jurisdiction of those courts and that tribunal.
17.4 Consumers. If you are a consumer, nothing in this section takes away a right you have under the consumer protection laws of the province or territory where you live, including any right to bring a claim there.
18. General
18.1 Entire agreement. These Terms, our Privacy Policy and, for hosts, the Stripe terms, are the whole agreement between you and Rehostly about Rehostly.
18.2 Relationship. Hosts are independent. Nothing in these Terms makes a host our employee, partner or agent, except that we act as the host's limited agent to collect payment under section 5.2.
18.3 Transfer. You may not transfer your rights under these Terms without our written consent. We may transfer ours to a company that takes over all or part of Rehostly's business, and will tell you if we do.
18.4 Events beyond our control. We are not responsible for delays or failures caused by events we cannot reasonably control, such as outages of our providers, internet failures, natural disasters, or government action.
18.5 Severability and waiver. If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right at one time, we can still enforce it later.
18.6 Notices. We send notices to the email address on your account or the one you booked with. You can send notices to support@rehostly.ca.
